Since December 2023, the law firm Rosenvald Advogados worked on a large-scale international project. From that date on, Nelson Rosenvald participated as a Brazilian expert in private law in the world’s largest class-action lawsuit, which is being heard in London and involves more than 600,000 victims of the Mariana disaster seeking compensation. This is the largest lawsuit in history! The challenge consisted of analyzing and drafting legal opinions on fundamental issues, such as civil liability, statutes of limitations, and the compensation agreements previously signed in Brazil.
Over the course of a year of intensive research and debate, in-depth legal opinions were produced on the applicability of various provisions of the Brazilian legal system to the case. The firm’s accumulated experience in the area of civil liability was essential for providing the technical foundation for the legal arguments presented to the victims’ representatives and the judicial authorities. The arguments developed focused on the systematic interpretation of the principles of Brazilian law and their harmonization with the context of the ongoing proceedings in the United Kingdom.
Rosenvald’s involvement reached its peak in December 2024, with four days of rigorous cross-examination before the English court. This stage made it possible to clarify, directly to the presiding judge and other interested parties, the crucial aspects of Brazilian law applicable to the Mariana disaster. The meticulous scrutiny of the legal arguments revealed the consistency and depth of the research conducted, solidifying the firm’s technical contribution to the understanding of a complex and sensitive legal matter.
Now that its involvement in the case has concluded, Rosenvald Advogados remains committed to providing technical, transparent, and ethical legal services, even in high-profile cases.
